A main tenant who offers part of a rented home is usually creating a subletting arrangement, not acting as the property owner. The distinction matters because the main lease, the landlord’s consent and the sublease conditions all need attention.

Understand the basic Swiss framework

Article 262 of the Swiss Code of Obligations addresses subletting. It provides for the tenant to sublet all or part of the property with the landlord’s consent and identifies circumstances in which consent may be refused. Read the current Swiss Code of Obligations on Fedlex and obtain qualified advice for your specific situation. This guide is practical information, not legal advice.

Give the landlord enough information to assess the proposal. This normally includes:

  • The part of the home being sublet
  • Proposed start date and duration
  • Subtenant’s identity
  • Monthly rent and additional costs
  • Main conditions of the proposed sublease
  • How the room and shared areas will be used

Written communication creates a clearer record than an informal conversation.

Keep the price explainable

The room price should be transparent in relation to the main lease, private room, shared-space access, furnishing and included costs. Do not hide surcharges. Use the Basel WG room rent estimator only as an indicative market starting point, then check the legal and contractual position separately.

Create a written sublease

Record the parties, room, shared areas, term, rent, payment date, deposit, utilities, house rules, notice and handover condition. Make sure the sublease does not promise rights that the main lease does not provide. Keep signed copies and a dated inventory.

Screen consistently and protect data

Ask applicants for information relevant to the rental decision and apply the same process consistently. Avoid collecting sensitive documents before they are needed. Store what you receive securely and delete information that no longer has a purpose.

Publish only after the essentials are ready

Before listing, confirm:

  • Landlord consent addressed
  • Proposed conditions disclosed
  • Availability and duration fixed
  • Price and utilities documented
  • Furniture inventory and room condition recorded
  • House rules aligned with the main lease

Then follow the step-by-step Basel room rental guide and create the room listing on RumyFi. A careful setup protects the relationship between landlord, main tenant and subtenant and gives applicants a clearer offer.
